This Privacy Policy explains how Novomins Australia Pty Limited ("Novomins", "we", "us", or "our") collects, uses, discloses and protects your personal information when you visit www.novomins.com.au (the "Site"), place an order (including a subscription order) directly with us, or otherwise interact with us in Australia. We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

2. Information We Collect

2.1 Personal Information You Provide

We collect personal information that you provide directly, including:

2.2 Device & Usage Information (Collected Automatically)

2.3 Payment & Order Information

When you place a one-off or subscription order on the Site, we collect the order and delivery details needed to fulfil it. Subscription orders are managed using Appstle Subscriptions, a third-party subscription platform integrated into our checkout, which processes your recurring order and billing schedule on our behalf.

Payment card and payment method details are collected and processed by our payment processors, which may include PayPal, Shop Pay, Apple Pay, and other providers offered at checkout. We do not store your full card number; each payment processor handles your payment details in accordance with its own security standards and privacy policy.

3. Why We Collect & Use Personal Information

We collect, use and disclose personal information only for purposes directly related to our business functions and activities, including to:

● Process, fulfil and deliver your one-off and subscription orders;

● Arrange delivery through our courier and logistics partners;

● Send transactional communications, including order confirmations, shipping updates, and subscription renewal or cancellation notices;

● Operate, maintain and improve the Site (analytics, performance, debugging);

● Respond to enquiries and provide customer support;

● Detect, prevent and investigate security incidents or fraudulent activity;

● Send marketing communications where you have opted in, in accordance with the Spam Act 2003 (Cth) and our Terms of Service;

● Comply with legal obligations and requests from regulators or law enforcement.

We do not use or disclose personal information for unrelated secondary purposes unless we have your consent or are otherwise permitted by law.

5. Service Providers Supporting Your Order, and Third-Party Retailers

5.1 Service Providers

To operate the Site and fulfil orders placed directly with us, we share relevant personal information with service providers who help us run the business, including:

● Our payment processors (including PayPal, Shop Pay, Apple Pay, and other providers offered at checkout), to process payment for one-off and subscription orders;

● Appstle Subscriptions, to manage recurring subscription billing and delivery schedules;

● Our delivery couriers and logistics partners, to deliver your order;

● Analytics, advertising, and email marketing platforms (see Sections 4 and 3).

These providers are only permitted to use your personal information to provide services to us, and not for their own independent purposes, except as required by law.

5.2 Products Sold Through Third-Party Retailers

Novomins products are also available for purchase through third-party retailers, independent of our own Site. Where you buy a Novomins product through a third-party retailer, that retailer — not Novomins — collects, holds and is responsible for any personal information you provide as part of that purchase, and its own privacy policy (not this one) governs how that information is handled. Novomins is not responsible for the privacy practices of third-party retailers or for sales made outside our own direct-to-consumer channels.

6. Disclosure of Personal Information (incl. Overseas)

We disclose personal information to the service providers listed in Section 5, and may also disclose information if required by Australian law, to respond to lawful requests, or to protect our rights.

Overseas disclosures: Some service providers (including our e-commerce platform, payment processor, subscription platform, and analytics/advertising partners) may be located or may process personal information outside Australia, including without limitation the United States, Canada, the United Kingdom and/or the European Union. We take reasonable steps to ensure such providers comply with the APPs or are subject to substantially similar protections.

7. Data Security & Retention

We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. Measures may include access controls, encryption in transit, firewalls, staff training and regular reviews.

Personal information is retained only for as long as reasonably necessary for the purposes described in this Policy, including to meet our legal and tax record-keeping obligations (for example, order and transaction records are generally retained for at least 5 years to meet Australian tax law requirements). When no longer required, we take reasonable steps to securely destroy or de-identify personal information.

8. Your Rights: Access & Correction

Subject to certain exceptions under the Privacy Act, you have the right to request access to the personal information we hold about you and to request correction if it is inaccurate, out-of-date, incomplete, irrelevant or misleading.
